Compensation Policy for Damaged Office Chairs

Admin October 16, 2026

Whether compensation is required for damaged office chairs depends on the cause of the damage and company regulations, and cannot be generalized.

Deliberate Damage

If an employee deliberately damages an office chair, according to Article 49 of the Public Security Administration Punishment Law of the People's Republic of China, the employee is required to compensate for the value of the office chair and may also face public security administrative penalties. Deliberate damage violates basic moral and legal standards, and the company has the right to request the employee to bear corresponding compensation responsibilities to safeguard its property rights.

Unintentional Damage

  • Normal Wear and Tear: Wear and tear or aging of office chairs that occur during normal use as office supplies are considered normal. In such cases, the company usually bears the replacement or repair costs, and employees are not required to compensate. This is because it is an unavoidable phenomenon during the use of office supplies, and the company has a responsibility to provide employees with office equipment that functions properly.
  • Gross Negligence: If an employee causes damage to an office chair due to gross negligence, such as violent impact or improper use, the company has the right to request compensation, but must provide sufficient evidence. Gross negligence indicates that the employee did not exercise reasonable care during use and bears some responsibility for the damage to the office chair, so the company can request compensation.

Company Regulations

  • Property Management Regulations: The company may clarify employees' responsibilities and compensation methods for using company property through internal regulations, and employees need to understand these regulations. These regulations are formulated by the company to standardize employee behavior and protect company property, and employees should comply with them when using office chairs.
  • Labor Contract Agreements: If there is a damage compensation clause in the labor contract, employees are required to compensate according to the agreement. The labor contract is an important legal document between the employee and the company, and both parties should abide by its terms.

Compensation Process

The company first assesses the repair costs. If the costs are low, it may repair the chair itself. If compensation is required, both parties need to negotiate the amount and method, taking into account the employee's financial situation and the actual circumstances of the damage. After reaching an agreement, the employee fulfills the compensation. If the employee refuses or an agreement cannot be reached, the company can take legal measures.
