What to Do If You Fall Off an Office Chair

Admin October 08, 2026

After falling off an office chair, you should seek medical attention immediately and retain evidence, then determine liability based on the specific circumstances and resolve compensation issues through negotiation or legal means.

Seek Medical Attention Promptly and Retain Evidence

After falling, you should go to the hospital for treatment as soon as possible to ensure that your physical condition is professionally evaluated and handled. At the same time, you need to retain key evidence such as on-site photos, medical records, and diagnostic certificates. These materials are important bases for subsequent liability determination and compensation negotiation.

Determine Whether It Is a Work-Related Injury

According to the Regulations on Work-Related Injury Insurance, if the fall occurs during working hours and at the workplace and is caused by work-related reasons, it can be recognized as a work-related injury. Eligible individuals need to apply for work-related injury recognition with the labor and social security administrative department within 30 days from the date of the accident. If the unit fails to apply in a timely manner, the injured worker, their close relatives, or the trade union organization can directly apply within 1 year. When applying, materials such as a work-related injury recognition application form, proof of labor relations, and medical diagnosis certificates need to be submitted. After being recognized as a work-related injury, you can enjoy work-related injury insurance benefits, including medical expenses and wages during the period of work stoppage for medical treatment. If the unit has not paid work-related injury insurance, the unit shall bear all compensation liabilities.

Liability Determination

  • Unit Liability: The unit has a safety guarantee obligation for its business premises. If the fall is caused by facility problems such as a damaged chair and the unit fails to repair, replace, or set up warning signs in a timely manner, it needs to bear corresponding compensation liabilities.
  • Personal Liability: If the fall is caused by personal negligence (such as not observing the condition of the chair or violating safety regulations), you may need to bear the main or all responsibilities yourself.
  • Mixed Liability: If both the unit and the individual are at fault (for example, the unit fails to repair a damaged chair, and at the same time, the individual fails to observe), the liability will be shared according to the degree of fault.

Subsequent Handling

  • Work Capacity Assessment: If there is a disability or an impact on work capacity after the injury stabilizes, you need to apply to the municipal-level work capacity assessment committee in the districted city for assessment to clarify the disability grade.
  • Negotiation or Legal Means: After collecting sufficient evidence, you can negotiate compensation matters with the unit, rationally express your demands, and negotiate in accordance with laws and regulations. If the negotiation fails, you can resolve the dispute by filing a complaint with the labor supervision department or initiating a civil lawsuit in court.
