No Measurement for Custom Office Chairs

Admin October 16, 2026

If the merchant fails to measure the dimensions in person when customizing office chairs, the following handling methods can be adopted based on the contract agreement and the actual situation:

  1. The contract explicitly stipulates that the merchant is required to measure the dimensions in person: The merchant's failure to fulfill this obligation constitutes a breach of contract. You can request the merchant to complete the measurement within a specified time limit and bear the losses caused by the delay in measurement, such as rental transition fees and decoration suspension losses. This is based on the contract agreement. The merchant is obligated to fulfill the promised service content, and failure to do so requires bearing corresponding responsibilities.

  2. The failure to measure the dimensions results in the custom office chairs not matching the room space: If the chairs have been produced but the dimensions are completely inconsistent, you can claim to terminate the contract in accordance with the Consumer Protection Law, request the merchant to fully refund the advance payment, and compensate for the reasonable losses incurred while waiting for the custom office chairs. In this case, the merchant's behavior has seriously affected your normal use, and you have the right to safeguard your legitimate rights and interests.

  3. The merchant defends itself on the grounds that 'you did not actively provide the dimensions': It is necessary to check whether the contract stipulates that 'you are required to provide the dimensions yourself'. If not, as a professional customizer, the merchant should actively fulfill the obligation of measurement, and the defense is untenable. The merchant cannot transfer its own obligations to consumers.

  4. The contract stipulates a 'non-refundable clause': If this clause has not been deemed invalid, you may only request the merchant to make up the measurement. However, if the merchant has unreasonable behaviors such as intentional delays, you can further assert your rights and interests.

  5. The merchant has not measured the dimensions but has completed the design plan: If design costs have been incurred, the merchant may request a refund after deducting the design fee. At this time, it is necessary to determine whether the design is a 'reasonable service without measurement'. If the design plan cannot be used due to the lack of measurement, you can refuse to pay the design fee.

  6. The merchant is unable to measure the dimensions in person due to force majeure: Such as epidemics, natural disasters, etc. The merchant can claim to postpone the performance. You cannot directly request to terminate the contract but need to negotiate with the merchant to postpone or change the service method.
